St. George’s School

A teacher arrested over a Suffolk private school sex abuse inquiry killed himself by taking a drugs overdose, a coroner rules.

The BBC has reported:

Alan Williams, 59, was found at his home in Stowupland Street, Stowmarket, on 10 June last year, eight days after police extended his bail.

The inquiry related to his time at St George’s School, Great Finborough, in the 1980s.

A coroner, sitting in Bury St Edmunds, ruled Mr Williams killed himself.

Mr Williams was arrested in February over an investigation into incidents at the former St George’s School.

The arrest of Mr Williams followed the conviction of St George’s former headteacher Derek Slade for more than 50 offences including child sex abuse and assault.

Nigel Leat victims may have rise to compensation claims – Hillside First School

Harrowing cases of child sex abuse are being aired in the media almost every day.

Last month, Nigel Leat, 51, was jailed indefinitely for abusing children at Hillside First School in Weston-super-Mare. Leat, of Bloomfield Road in Bristol, admitted 36 sexual offences at Bristol Crown Court in May 2011.

A serious case review was commissioned after Leat’s 2010 arrest at the instigation of the North Somerset Safeguarding Children Board. The review identified 20 pupils who were witnesses or victims of abuse by Leat, describing the failure of the school management as “lamentable”. The report revealed that 30 incidents were witnessed by staff but only 11 reported to the headteacher, Chris Hood, who failed to pass the concerns to the local education authority.

It’s likely that a number of Leat’s victims will bring claims against North Somerset Council, and ultimately its insurers, especially with the damning report finding significant failings in the school.

Legal aid is likely to be available in a some cases, but if this is not available then there are other funding alterntives such as conditional fee agreements.

The Limitation Act 1980 says that a victim of child abuse has three years from their 18th birthday to bring a claim before the courts, and if they fail to do so they are too late. Victims needs to have this in their mind should they be considering a claim for compensation.

The courts are taking an increasingly tough line with those failing in their duty of care to children. In October, a unitary authority was ordered to pay almost £320 000 in damages to four claimants who suffered “the most appalling” abuse at the hands of their father, after finding it vicariously liable for the negligence of social workers employed by its predecessor authority. The judge awarded sums to the claimants ranging from £59 476 to £155 487.

Nigel Leat was jailed indefinitely for sexually abusing children

A teacher was able to film himself abusing young girls because of a “lamentable failure” by school management, a review has found.

Nigel Leat, 51, was jailed indefinitely for abusing children at Hillside First School in Weston-super-Mare.

At his trial, which heard Leat abused five victims, some as young as six, the judge described him as a “paedophile of the most sickening order”.

The serious case review was commissioned after Leat’s 2010 arrest.

Leat, of Bloomfield Road in Bristol, admitted 36 sexual offences at Bristol Crown Court in May last year.

The charges included one count of attempted rape, 22 of sexually assaulting a child under 13 and eight of sexual assault by penetration.

The offences were committed between September 2006 and December 2010, when Leat was arrested.

A report carried out by Leat’s school while he still worked there referred to at least 30 incidents of “inappropriate or unprofessional conduct” involving the teacher.

The serious case review, commissioned by North Somerset Safeguarding Children Board, said the incidents in the school management report ranged from indecent touching to inappropriate lesson content and over-familiarity with children.

The abuse happened at Hillside First School in Weston-super-Mare

Leat joined the school in September 1995 as a newly-qualified teacher.

The case review said a number of school staff had “a variety of concerns” about him within a year of his appointment and throughout the time that he worked there.

On at least three occasions, children reported that Leat was ‘touching their legs and kissing one child, a teaching assistant also witnessed Leat sitting on cushions with a female pupil, and noted he was sexually aroused.

Other complaints included children posing inappropriately with the teacher for pictures taken on the school camera.

The report states: “Within a year of his appointment, and throughout the time that he worked in the school, a number of teaching and support staff in the school had a variety of concerns about the teacher.

“The overwhelming impression is that (Leat’s) behaviour was characterised by a general lax approach to teaching and classroom discipline with significant displays of favouritism towards a small number of children in his class.

“These pupils were allowed to be over-familiar with the teacher, who was known to speak and joke with his pupils in a manner which was inappropriately adult.

“The failure to address the favouritism towards certain pupils is indicative of poor performance management and should have been of particular concern as it was recognised that the favouritism was shown only to girls and was accompanied by an over-familiarity between (Leat) and pupils with whom he was frequently observed to be in inappropriately close physical contact.

“These pupils were invariably girls and were described by staff members as pupils who were less academically able, emotionally needy and pretty.

The review identified 20 pupils who were witnesses or victims of abuse by Leat.

Leat was given an indeterminate sentence and told he must serve at least eight-and-a-half years before he can be considered for parole.

Last month the school’s head teacher Chris Hood left his post, having been suspended since January 2011.

The victims of this man are able to not only pursue him through criminal proceedings but may have rise to a civil claim.

They may be able to pursue claims for compensation for damages against Leat himself and also North Somerset Council, who are vicariously liable for his assaults.

We would be interested to hear from relatives of victims or the victim themselves to discuss how we may be able to assist in their fight for justice.

Two Soldiers arrested over Afghanistan child abuse claims

UK troops arrested over Afghanistan child abuse claims

Soldier on patrol The Ministry of Defence said it takes abuse allegations “extremely seriously”

Military police are investigating allegations of child abuse by two British soldiers in Afghanistan.

The Sun newspaper said the separate incidents were filmed and shown to colleagues on laptop computers.

The Ministry of Defence said it took such claims “seriously” and the Royal Military Police were investigating.

The BBC understands that the two soldiers do not belong to the Mercian battle group as was originally reported by the MoD.

The army is not willing to name their unit.

“We are aware that an allegation has been made concerning alleged inappropriate behaviour by two servicemen in Afghanistan,” said a spokeswoman.

“The Royal Military Police (Special Investigations Branch) has launched an investigation into this. We take any such allegation extremely seriously.”

“If a service member is found to have committed an offence, or behaved in a manner not in keeping with the appropriate moral standards expected of them, they will be dealt with appropriately through the respective nation’s military judicial system.”

We have been approached before by victims of assault by soldiers.

Those victims may have rise to a civil claim for damages/compensation.  If the assault occurred outside of Britain and was by a British Soldier, it can still be pursued under the English jurisdiction.

Queen Mary 2 and Queen Elizabeth child abuse claims investigated

Police are investigating allegations that children were abused by a worker on two luxury Cunard cruise ships.

The unnamed man from Wiltshire no longer works for the company, a spokeswoman for Wiltshire Police said.

The abuse is alleged to have happened on the Southampton-based Queen Mary 2 and the Queen Elizabeth over five years, the Mail on Sunday reported.

A Cunard spokesman said it was co-operating fully with the police inquiry.

It said in a statement: “We are deeply shocked by these allegations as the safety and wellbeing of our customers is of paramount importance to us.

“A thorough police investigation is under way which we are supporting and co-operating with fully.

“And we are working closely with the NSPCC to ensure that affected families and children are cared for and offered appropriate support.”

At this moment in time the amount of children who have made allegations is unknown.

The children who make such allegations may have rise to a civil claim for damages/compensation.  They will have to act soon as age dependant they may face time restrictions under the Limitation Act 1980 if they leave their claims too long.

Monk jailed for abuse at Downside School

Monk jailed for abusing two boys at Somerset school

Richard David White
Richard David White taught at Downside School in the 1980s
A monk who taught at a Roman Catholic school in Somerset has been jailed for five years for child sex offences.

Richard David White, 66, pleaded guilty to five counts of indecent assault and two of gross indecency with a boy at a previous hearing last November.

He asked that four offences against another boy, who has never complained to police, also be taken into account.

White, of Hyde, Fordingbridge, Hampshire was sentenced at Taunton Crown Court.

The offences took place in the 1980s when he taught at Downside School in Stratton-on-the-Fosse.

The court heard that White was warned about his behaviour after molesting one 12-year-old boy but, instead of being reported to police, the Benedictine abbot of the monastery, which is attached to the school, simply prevented him from teaching younger students.

He went on to indecently assault a second boy – the one he was charged with assaulting – over the course of several months while he was aged 12 and 13.

‘Truly sorry’

Sentencing White, Judge Graham Hume Jones said: “You targeted this complainant and took advantage of his interest in old books and maps, you gave him access to the monastery library which is not normally open to pupils to indulge in your own sexual gratification.”

White groomed the victim by giving him small sums of money.

The judge said he acknowledged there was no evidence to show he committed any further offences beyond 1989.

One of his victims who attended court said it was an “appropriate” sentence and would highlight to Downside School “the risks of religious orders running educational establishments without the necessary safety nets”.

He called for an apology from the Roman Catholic Church which runs the school.

The Abbott for Downside School said: “Our first thoughts are for those who were abused as children.

“Being conscious that the care of children is our paramount concern as educators, we are truly sorry that any child should have been abused at Downside.”

He added that White has lived under restrictions since 1998 and has been withdrawn from active ministry.

JGE -v- The English Province of Our Lady of Charity and The Trustees of the Portsmouth Roman Catholic Diocesan Trust

Further to our blog post on the 17 November 2011, the judgment for the above case is now available on the Judiciary website.

It makes for an interesting and enlightening read.  It is considered that this judgment will assist Claimant solicitors in establishing vicarious liability between an office holder and the Diocese/Bishop/Dean.
